Terms And Conditions
1. Agreement
Your Hire Agreement is the document you sign when you collect the vehicle, generally headed “Hire Agreement”. It includes a summary of your hire, such as hire period, vehicle details, optional services selected, and an estimate of the charges payable.
By signing the Hire Agreement, you confirm and agree that:
- The information contained in the Hire Agreement is complete and accurate.
- You accept and agree to be bound by:
- The terms and conditions set out in the Hire Agreement.
- These Vehicle Hire Terms and Conditions.
- Any additional terms, notices, or policies provided to you (together referred to as the “Agreement”).
- You further agree to pay:
- Agreed hire charges for the vehicle.
- Compulsory charges, taxes, or fees applicable in Guernsey, UK and Europe.
- Charges for any optional services selected.
- Additional charges arising during or after the hire, including excess charges, damage costs, late return fees, fuel charges, cleaning fees, fines, or administration fees.
Each Hire Agreement will display hire charges for a maximum number of days, as stated on the Hire Agreement. If your hire period exceeds this, you must request an updated estimate.
2. Responsibility
Our Responsibilities
- Provide a vehicle that is safe, roadworthy, and legally compliant.
- Maintain the vehicle according to safety standards.
- Replace the vehicle, where practicable, in the event of breakdown, theft, or accident unless caused by Prohibited Use.
Your Responsibilities
- Take reasonable care of the vehicle.
- Pay all hire charges and other amounts due.
- Ensure all information you provide is accurate and complete.
- Hold a valid driving licence recognised in Guernsey.
- Comply with all laws and regulations regarding vehicle use.
3. Privacy
By hiring with us, you consent to collection, storage, use, and disclosure of your personal information, including via vehicle tracking, in accordance with our Privacy Policy.
4. Self-Drive Hire Insurance
Insurance will be provided to you by WMS via our insurer.
5. Long-Term Hires and Invoicing
For hires of 28 days or longer:
- You will be invoiced at the beginning of each 28-day period or as otherwise agreed.
- Hire charges on the agreement may only cover a limited period—request a full-period estimate if needed.
6. Termination of Hire Agreement
Termination by WMS
- You fail to pay charges or your payment is declined.
- Law enforcement or regulatory authorities require vehicle repossession.
- WMS reasonably believes there has been or will be a breach or Prohibited Use.
Termination for Convenience
- WMS may terminate with 28 days’ notice and repossess the vehicle at your expense.
7. Vehicle Condition
- Inspect the vehicle at start and on return.
- A Vehicle Condition Report will record pre-existing damage.
- Notify WMS of any damage not recorded before leaving the hire location.
8. Care of the Vehicle
- Take reasonable care and avoid Prohibited Use.
- Use the correct fuel and maintain fluids and tyre pressures.
- Report any warning lights or mechanical issues immediately.
9. Maintenance and Servicing
- For hires over 28 days, return the vehicle for servicing as required.
- Follow WMS instructions regarding servicing or vehicle replacement.
10. Fuel
- Vehicle will be supplied with a full tank.
- Return with a full tank or pay for refuelling at the current rates plus a administration fee.
- Use only the fuel specified by WMS.
11. The Driver
- Only authorised drivers may operate the vehicle.
- Drivers must be a minimum of 25 years old, hold a full valid licence in English or certified translation, and have held it for at least 12 months.
- Additional drivers must be added to the agreement and pay the applicable fee.
- No provisional driving licences allowed.
12. Prohibited Uses
- Reckless, intentional, or negligent damage.
- Driving under the influence of alcohol and drugs.
- Using the vehicle for illegal acts or racing.
- Overloading or towing without permission.
- Driving in restricted areas, off-road, or on beaches/flooded roads.
- Transporting hazardous materials without authorisation.
- Any other use deemed inappropriate by WMS.
Violation may lead to:
- Termination and repossession at your expense.
- Liability for full vehicle value and any related losses.
13. Returning the Vehicle
- Return by the agreed date, time, and location.
- Vehicle must be in the same condition, except fair wear and tear.
- Late or wrong-location returns may incur additional charges.
- Unaccompanied return of vehicle to Guernsey, further charges, terms and conditions will apply.
14. Repossession of the Vehicle
- WMS may recover or repossess vehicles not returned, including entering your premises.
- Vehicle may be reported stolen if not returned.
- You remain liable for all costs, damages, and hire charges.
15. Damage and Loss Responsibility
- Report incidents promptly and complete Vehicle Incident Report (VIR).
- Pay costs of repair or recovery, except fair wear and tear, WMS negligence, or recoverable third-party damage.
- Liability applies even if the incident was not your fault, unless otherwise stated.
16. Damage to Third Parties
- WMS maintains insurance for liability to third parties.
- Policy excludes coverage where other insurance applies, for vehicle damage, or hazardous use. WMS will require signed documents to prove that WMS will be the first payee on any claim.
- You must cooperate with WMS or insurers and pay any applicable excess.
17. Payment
- All hire charges and off island fees. Please refer to charge list.
- Any charges incurred at the time of hire that come to light after the hire period i.e. speeding charges, government charges, parking charges will be invoiced accordingly.
- Costs and damages for which you are liable, including fuel, repairs, towing, and repossession.
- Legal fees or other costs incurred by WMS in enforcing this Agreement.
